Judge Rules Health Law is Constitutional


 

A judgment was issued on October Seventh 2010 by The Federal District Court in Detroit: Judge George C. Steeh presiding. That the Health Care bill is Constitutional. He used the Commerce Clause of the United States Constitution to make the point that if everybody was forced to buy insurance that it would be reasonable to conclude that it would be cheaper for everybody to purchase, so it would "substantially affect interstate commerce " which is the standard set by the Supreme Court.

The challenge to the Health care bill was brought by the Thomas More Law Center and Michigan residents. A lawyer from the center said it "was nicely set up for appeal" Two other challenges will also be heard in Florida and Virginia Dec 16th and Oct 18th respectively.

This is the first time that the law was deemed constitutional and the stated that it was a "issue of first impression". A spokeswoman from the Justice dept. welcomed the holding.
